How?
Consider the following;
Case 1:
Party (A) signs an agreement to purchase a property that requires a deposit of 20% with strict payment terms.
He goes ahead and borrows KSH 600k to place the deposit for the property.
Unfortunately and due to unavoidable circumstances, party A cannot fulfill the other contract terms and the property owner enforces the 10% forfeiture clause.
Party A decides to sue the property owner and loses the case, forfeits the deposit paid, he’s left with a debt, and in addition, pays the legal costs. All because of……???
Case 2:
Party B faces a similar situation as Party A but decides to negotiate with the property owner to be allowed to look for a substitute purchaser and eventually party B gets a buyer and the deposit earlier paid is refunded.
Party A’s ego leads to the loss of the deposit, legal costs, and a tainted relationship with the property owner.
Party (B) uses wisdom and humility to avoid losing the deposit and enhance the relationship with the property owner.
